Terms of service

Effective date: [date you publish] · [Your LLC name], doing business as NiteLine

Draft. Have an attorney review this before you publish it on your own domain or ask a client to agree to it. Replace every item in [brackets].

These terms are an agreement between [Your LLC name] ("NiteLine", "we") and the business that signs up for our service ("you"). By starting a trial or a paid plan, you agree to them.

The service

NiteLine provides an AI receptionist that answers calls forwarded from your business line, collects caller details, books appointments into time slots you approve, and sends you a summary and recording of each call. We set it up for you based on the information you provide.

Free trial

Your first 14 days are free, including all call minutes. We'll remind you before the trial ends. If you don't want to continue, turn off call forwarding and tell us, and you won't be charged.

Billing

First-month guarantee

If, in your first paid month, the appointments booked by the receptionist are worth less than that month's fee, we'll refund that month. "Worth" means the value of booked jobs as shown in your weekly reports, using the average job values you confirm with us at setup. Request the refund within 14 days after the month ends.

Cancellation

You can cancel at any time by email or phone. Your plan runs until the end of the billing month you've paid for, and we don't charge again after that. Turning off call forwarding stops calls from reaching the receptionist right away.

Your responsibilities

Call recording

The receptionist tells each caller at the start of the call that it may be recorded. You agree not to ask us to remove that notice. Recordings are handled as described in our privacy policy.

What AI can and can't do

The receptionist is software. It can mishear a caller, book the wrong slot or give an incomplete answer. We review calls during your first weeks and fix problems quickly, and you get a recording of every call so you can catch errors. It is not an emergency service: for gas leaks, fire, electrical hazards or anything life-threatening, it tells callers to contact 911 or their utility.

Availability

We rely on outside providers for voice AI, phone service and calendars. We'll work to keep the service running, but we can't promise it will never be interrupted. If an outage lasts more than [24 hours], we'll credit that time on your next bill.

Limitation of liability

To the extent the law allows, our total liability for any claim related to the service is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, lost jobs or indirect damages, including from missed, misheard or incorrectly booked calls.

Ending the service

We may suspend or end your service if you don't pay, or if you use it unlawfully or in a way that harms callers. Otherwise, we'll give you 30 days' notice. When the service ends, you can ask for a copy of your call records within 30 days.

Changes to these terms

We'll email you at least 30 days before any significant change. If you keep using the service after that, the new terms apply.

Governing law

These terms are governed by the laws of North Carolina.
